In recent years Americans have become more and more alarmed at the lack of adherence to the U.S. Constitution exercised by Congress and other elected representatives. The list of violations has grown large indeed.

Some have tried to fight the violations through the election process, attempting to remove those representatives who have perpetrated them. Others have tried to fight infringing legislation as it is introduced. Still others have fought in the courts, attempting to defend liberties in front of judges who have sworn to uphold the Constitution.

To date, little has worked as many elected representatives and court rooms openly defy the Constitution, calling it antiquated. Justices of the U.S. Supreme Court announce that they now look to international law for precedence and guidance, rather than the Constitution. Government at all levels is growing ever further from the reach of the people. In such a growing desperate situation is it possible to restore the Republic to the vision of the Founding Fathers?

We want to be clear. DownsizeDC.org is, by law, non-partisan. But the managers of DownsizeDC.org go one step further. We are philosophically and tempermentally ANTI-partisan. We believe political parties are a problem, not a solution.
Likewise, we're skeptical of politicians. Any person who thinks he or she is qualified to make decisions for others, and to coerce others to abide by those decisions, is automatically suspect in our eyes. Politicians, almost by definition, are people who feel qualified to use government coercion to manage other people's lives.
We disagree with them. They aren't qualified. No one is.
In our view the best a politician can do is work to limit the use of government power. These boundaries are required by the Constitution and the Bill of Rights. Sadly, most politicians are too impressed with themselves to limit themselves in such a way.
This fact motivates us to be both anti-partisan and anti-politician.
Where most people look to parties and politicians for solutions, we favor skeptical thinking, limited, decentralized power structures, individual liberty, and personal responsibility. We prefer to deal with issues, ideas, and principles.
Here's where the potential for misunderstanding arises. Most people are used to thinking in terms of parties and personalities. Thus, if we support or oppose a policy associated with a particular party or politician, some jump to the conclusion that we are being partisan -- that we're picking sides.
Nothing could be further from the truth. We care about the issue, not the party or the politician.
For the past four years we've opposed (and only occasionally supported) policies associated with Republicans in general, and President Bush in particular. Some have assumed from this that we're anti-Republican, anti-Bush, and pro-Democrat.
Now we have the opposite problem. The Democrats have gained control of Congress and the White House. We've responded by opposing coercive Democratic proposals. As a result . . .
Some people jump to the conclusion that we're anti-Democrat, anti-Obama, and pro-Republican. Again, nothing could be further from the truth.
What we are, and intend to remain, is consistent.
Once again, we believe all politicians, of all parties, are fundamentally unqualified to decide how other people should live. We do not believe in top-down social engineering by Republicans, Democrats, or anyone else. We believe in critical thinking, limited, decentralized power structures, individual liberty, and personal responsibility.
One hallmark of critical thought is the rejection of special pleading. Special pleading is when you have one standard for yourself, and a different standard for others. Loyalty to parties and politicians lends itself to special pleading and rank hypocrisy. We believe such loyalty is inherently toxic to the mind. We think it also damages the social fabric via unnecessary culture wars.
We've pointed before to brain scan studies showing that partisan loyalists experience pleasure from lying on behalf of their own party. Our "quote of the day" comes from the lead scientist in these studies. We want to protect ourselves from this kind of dishonesty and non-thinking.
We do this by being loyal to our principles and nothing else.
Therefore, anyone who writes to us accusing us of being anti-Democrat, anti-Obama, or pro-Republican, is mistaking us for someone else.
Personally, we (the undersigned) admire Obama's intelligence and composure. We also take pleasure in the fact that an African-American family will soon occupy the White House. But . . .
This won't keep us from criticizing things like his vote to legalize warrantless spying and to immunize the telecom companies that aided such spying. Neither can we endorse his eagerness to spend a trillion dollars to supposedly stimulate the economy.
We opposed the stimulus package when Bush wanted it. We'll continue to oppose it now that Obama wants it. We don't do special pleading.
If you believe as we do that the stimulus bill will be full of waste, corporate welfare, and favors to political interests, then please send Congress a message opposing this bill. Do it now, and keep doing it until the vote is held. You can use our quick and easy Educate the Powerful system to send your message.

Mystical Rose -- Hour of Grace on December 8

Acknowledgments: A Very special Thank you to the Felician Sisters in
general who printed this story in their "AVE MARIA" magazine
and who so graciously translated this story from Polish into English in
order to comply with the request of the Blessed Virgin Mary that this
message be sent throughout the world.

During the period of November 24, 1946 to December 8, 1947, the Blessed
Mother appeared to Sister Pierrina in a little church in Montichiari,
Italy, eleven times.

On the first appearance the Blessed Mother told Sister Pierrina that She
wanted to be known as the 'Mystical Rose' and that an hour of grace
should be kept at noon, December 8th in all the Catholic Churches of the
world. The Blessed Mother wanted this to be known through all of Italy
and the entire world.

It was November 16, 1947 when Sister Pierrina was finishing her
thanksgiving after Holy Communion when she saw a great light. She then
saw a vision of the Blessed Mother as the 'Mystical Rose'.

Sister was so deeply moved by the stunning beauty of Our Lady that she
began talking to Her. All of a sudden a gentle force made her kneel down
in front of Our Lady. The Blessed Mother spoke these words. "My Son
is greatly offended by the sins of impurity. He is already planning to
end the deluge upon the people, for their destruction, but I have asked
him to show mercy and not send the destruction. So that is why I have
appeared to ask for penance and atonement for the sins of
impurity."

Then the Blessed Mother asked for an Act of Humility by Sister Pierrina.
She asked her to make the sign of the cross with her tongue on each of
the stones in the Sanctuary. "This shall be a reminder to the people
that I have appeared here and do not have the people step on those
stones."

The Blessed Mother then stepped on each of the stones so that Her gown
touched all four stones.

On the 22nd of November, Sister Pierrina felt the overwhelming urge to go
to Church at 4:00. The Mother Superior, four Sisters and a group of
friends accompanied her. They were all saying the Rosary when the Blessed
Mother appeared as before.

She instructed Sister Pierrina to make the sign of the cross on the
stones and fence them off so that no one would step on them.

Again Our Lady asked for penance. She said, "Penance is nothing more
than accepting all our crosses daily willingly. No matter how small,
accept them with love. "At this time, she told sister Pierrina to
come again on December 8th at noon. "This will be My Hour of
Grace.". The Sister asked how she was to prepare for this Hour of
Grace? To which the Blessed Mother said, "With Prayers and Penance.
Pray the 51st Psalm with outstretched arms three times. During the Hour
of Grace, many spiritual graces would be granted. The most hard-hearted
sinners will be touched by the grace of God."

The Blessed Virgin promised that whatever a person asked Her for during
this Hour of Grace (even in impossible cases) would be granted to them,
if it was in accordance with the will of the Eternal Father.

It was December 7th when Sister Pierrina felt the urge to go to Church.
This time she was accompanied by the Priest and the Mother
Superior.

The Blessed Mother appeared with a young boy and girl dressed in
beautiful white clothing. Sister Pierrina was sure these little ones were
angels because they were so beautiful.

The Blessed Mother said, "Tomorrow I will show you My Immaculate
Heart which is so little known among the people." She asked people
to pray for Russia." There are so many people being held prisoners
which their families know nothing of because they have been gone for so
many years. Pray for the conversion of Russia, the suffering of the
soldiers and their sacrifices and martyrdom will bring peace to
Italy.

The little children are Francisco and Jacinta. I am giving them to you as
your companions. You will have much to suffer for My sake. I want
simplicity and goodness from you as of these little children." The
Blessed Mother then blessed Sister Pierrina, the Priest and all those who
were gathered there.

On the morning of December 8th people began arriving at the little Church
at 8:00 in the morning from neighboring towns. By noon, some 10,000
people had gathered to see the Blessed Mother, many of whom had to stand
outside because the Church did not have enough room for the large
crowd.

Sister Pierrina was accompanied to Church by her Mother and Brothers, the
Mother Superior and the Chief of Police from Montichiari. Sister was
reciting the Rosary with the crowd in the middle of the Church. Suddenly
a brilliant white light appeared from the ceiling. Stairs were coming
from the light down to the floor of the Church about fifteen feet in
length.

The staircase was beautifully decorated with red, white and yellow roses.
The Blessed Virgin appeared so radiant, dressed in white, with Her Hands
folded. She was standing on a splendid carpet at the top of the stairs
made of the red, white and yellow roses.

In the most gentle and loving voice, Our Lady smiled and began to speak.
"I am the Immaculate Conception, the Mother of all graces and the
Mother of my Beloved Son, Jesus. I want to be known as the Mystical Rose.
My wish is that every year on the 8th of December at noon an 'Hour of
Grace' will be installed. Many spiritual graces and physical blessings
will be received by those who pray undisturbed during this
hour." Then slowly she began to ascend the staircase gracefully
scattering roses as She went along until She reached midway of the
staircase. Here again the Blessed Mother spoke, "I am very happy to
see this great demonstration of Faith."

Sister Pierrina asked for many of the sinners to be forgiven. The Blessed
Mother replied. "My Divine Son will show his Greatest Mercy as much
as the people will pray for them. I want this to be known and told to
Pope Pius XII. Tell him I want him to install the 'Hour of Grace'
throughout the whole world and even for those who are not able to go
to Church during this time, can obtain this grace in their homes at noon
time."

She also asked that a Statue be made and placed on the spot where she
stood. This should be called the 'Rosa Mystica' and carried in procession
through the town at which time many graces will be given and cures will
take place. Then the Statue is to be returned to the Church.

Our Lady prayed for the sick, some will be cured others not. Many men,
women and children were cured at that very instant.

A twenty-six year old woman who could not say a word for nine months,
suddenly began shouting, "I see Her. I see the Blessed Virgin."
An eighteen year old girl with ulcers was instantly cured. A five year
old boy who had been paralyzed was told by the Blessed Mother, "Come
to Me, you will be walking now." He was placed on the Blessed Stones
and was able to walk.

There were three others who were very sick and were immediately cured.
But of course, the greatest miracles taking place were those of the
spiritual blessings being shed upon the people gathered in the
Church.

The Blessed Mother said, "This is the last time I will appear here.
Pray, weep and do penance on these Stones and you will receive the care
of My Motherly Heart." She then left the little Church, but because
of the Unending Love of Our Heavenly Mother, She has given us the 'Hour
of Grace' to be spread through the entire world. She had given all the
opportunity to demonstrate our love and trust to Her and to help make
reparation for the grievous sins offending Her Beloved Son, Our Lord
Jesus Christ.

REQUEST OF BLESSED MOTHER FOR THE HOUR OF GRACE

1. Day and time of Hour of Grace - December 8th Feast of the Immaculate
Conception - to be started at 12 noon and will continue until 1 PM (one
full hour of prayer)

2. During this hour the person making the 'Hour of Grace' either at home
or in the Church must put away all distractions (do not answer the
telephone or answer any doors or do anything but totally concentrate on
your union with God during this Special Hour of Grace)

3. Begin the Hour of Grace by praying three times the 51st Psalm with
outstretched arms. Psalm 51 can be found below.

4. The rest of the Hour of Grace may be spent in silent communication
with God meditating upon the Passion of Jesus saying the Holy Rosary,
praising God in your own way or by using favorite prayers, singing hymns,
meditating upon other Psalms, etc.

Please distribute this message to as many people as you can. Remember to
pray for your country during this hour. The Blessed Mother has requested
that Her message be sent throughout the entire world. Please help the
Blessed Virgin Mary to fulfill Her Mission well ... that all souls be
drawn to God and that Jesus will be loved in every heart. This is the
Perpetual song of her Heart. Let it also be ours.

general who printed this story in their "AVE MARIA" magazine
and who so graciously translated this story from Polish into English in
order to comply with the request of the Blessed Virgin Mary that this
message be sent throughout the world.

During the period of November 24, 1946 to December 8, 1947, the Blessed
Mother appeared to Sister Pierrina in a little church in Montichiari,
Italy, eleven times.

On the first appearance the Blessed Mother told Sister Pierrina that She
wanted to be known as the 'Mystical Rose' and that an hour of grace
should be kept at noon, December 8th in all the Catholic Churches of the
world. The Blessed Mother wanted this to be known through all of Italy
and the entire world.

It was November 16, 1947 when Sister Pierrina was finishing her
thanksgiving after Holy Communion when she saw a great light. She then
saw a vision of the Blessed Mother as the 'Mystical Rose'.

Sister was so deeply moved by the stunning beauty of Our Lady that she
began talking to Her. All of a sudden a gentle force made her kneel down
in front of Our Lady. The Blessed Mother spoke these words. "My Son
is greatly offended by the sins of impurity. He is already planning to
end the deluge upon the people, for their destruction, but I have asked
him to show mercy and not send the destruction. So that is why I have
appeared to ask for penance and atonement for the sins of
impurity."

Then the Blessed Mother asked for an Act of Humility by Sister Pierrina.
She asked her to make the sign of the cross with her tongue on each of
the stones in the Sanctuary. "This shall be a reminder to the people
that I have appeared here and do not have the people step on those
stones."

The Blessed Mother then stepped on each of the stones so that Her gown
touched all four stones.

On the 22nd of November, Sister Pierrina felt the overwhelming urge to go
to Church at 4:00. The Mother Superior, four Sisters and a group of
friends accompanied her. They were all saying the Rosary when the Blessed
Mother appeared as before.

She instructed Sister Pierrina to make the sign of the cross on the
stones and fence them off so that no one would step on them.

Again Our Lady asked for penance. She said, "Penance is nothing more
than accepting all our crosses daily willingly. No matter how small,
accept them with love. "At this time, she told sister Pierrina to
come again on December 8th at noon. "This will be My Hour of
Grace.". The Sister asked how she was to prepare for this Hour of
Grace? To which the Blessed Mother said, "With Prayers and Penance.
Pray the 51st Psalm with outstretched arms three times. During the Hour
of Grace, many spiritual graces would be granted. The most hard-hearted
sinners will be touched by the grace of God."

The Blessed Virgin promised that whatever a person asked Her for during
this Hour of Grace (even in impossible cases) would be granted to them,
if it was in accordance with the will of the Eternal Father.

It was December 7th when Sister Pierrina felt the urge to go to Church.
This time she was accompanied by the Priest and the Mother
Superior.

The Blessed Mother appeared with a young boy and girl dressed in
beautiful white clothing. Sister Pierrina was sure these little ones were
angels because they were so beautiful.

The Blessed Mother said, "Tomorrow I will show you My Immaculate
Heart which is so little known among the people." She asked people
to pray for Russia." There are so many people being held prisoners
which their families know nothing of because they have been gone for so
many years. Pray for the conversion of Russia, the suffering of the
soldiers and their sacrifices and martyrdom will bring peace to
Italy.

The little children are Francisco and Jacinta. I am giving them to you as
your companions. You will have much to suffer for My sake. I want
simplicity and goodness from you as of these little children." The
Blessed Mother then blessed Sister Pierrina, the Priest and all those who
were gathered there.

On the morning of December 8th people began arriving at the little Church
at 8:00 in the morning from neighboring towns. By noon, some 10,000
people had gathered to see the Blessed Mother, many of whom had to stand
outside because the Church did not have enough room for the large
crowd.

Sister Pierrina was accompanied to Church by her Mother and Brothers, the
Mother Superior and the Chief of Police from Montichiari. Sister was
reciting the Rosary with the crowd in the middle of the Church. Suddenly
a brilliant white light appeared from the ceiling. Stairs were coming
from the light down to the floor of the Church about fifteen feet in
length.

The staircase was beautifully decorated with red, white and yellow roses.
The Blessed Virgin appeared so radiant, dressed in white, with Her Hands
folded. She was standing on a splendid carpet at the top of the stairs
made of the red, white and yellow roses.

In the most gentle and loving voice, Our Lady smiled and began to speak.
"I am the Immaculate Conception, the Mother of all graces and the
Mother of my Beloved Son, Jesus. I want to be known as the Mystical Rose.
My wish is that every year on the 8th of December at noon an 'Hour of
Grace' will be installed. Many spiritual graces and physical blessings
will be received by those who pray undisturbed during this
hour." Then slowly she began to ascend the staircase gracefully
scattering roses as She went along until She reached midway of the
staircase. Here again the Blessed Mother spoke, "I am very happy to
see this great demonstration of Faith."

Sister Pierrina asked for many of the sinners to be forgiven. The Blessed
Mother replied. "My Divine Son will show his Greatest Mercy as much
as the people will pray for them. I want this to be known and told to
Pope Pius XII. Tell him I want him to install the 'Hour of Grace'
throughout the whole world and even for those who are not able to go
to Church during this time, can obtain this grace in their homes at noon
time."

She also asked that a Statue be made and placed on the spot where she
stood. This should be called the 'Rosa Mystica' and carried in procession
through the town at which time many graces will be given and cures will
take place. Then the Statue is to be returned to the Church.

Our Lady prayed for the sick, some will be cured others not. Many men,
women and children were cured at that very instant.

A twenty-six year old woman who could not say a word for nine months,
suddenly began shouting, "I see Her. I see the Blessed Virgin."
An eighteen year old girl with ulcers was instantly cured. A five year
old boy who had been paralyzed was told by the Blessed Mother, "Come
to Me, you will be walking now." He was placed on the Blessed Stones
and was able to walk.

There were three others who were very sick and were immediately cured.
But of course, the greatest miracles taking place were those of the
spiritual blessings being shed upon the people gathered in the
Church.

The Blessed Mother said, "This is the last time I will appear here.
Pray, weep and do penance on these Stones and you will receive the care
of My Motherly Heart." She then left the little Church, but because
of the Unending Love of Our Heavenly Mother, She has given us the 'Hour
of Grace' to be spread through the entire world. She had given all the
opportunity to demonstrate our love and trust to Her and to help make
reparation for the grievous sins offending Her Beloved Son, Our Lord
Jesus Christ.

REQUEST OF BLESSED MOTHER FOR THE HOUR OF GRACE

1. Day and time of Hour of Grace - December 8th Feast of the Immaculate
Conception - to be started at 12 noon and will continue until 1 PM (one
full hour of prayer)

2. During this hour the person making the 'Hour of Grace' either at home
or in the Church must put away all distractions (do not answer the
telephone or answer any doors or do anything but totally concentrate on
your union with God during this Special Hour of Grace)

3. Begin the Hour of Grace by praying three times the 51st Psalm with
outstretched arms. Psalm 51 can be found below.

4. The rest of the Hour of Grace may be spent in silent communication
with God meditating upon the Passion of Jesus saying the Holy Rosary,
praising God in your own way or by using favorite prayers, singing hymns,
meditating upon other Psalms, etc.

Please distribute this message to as many people as you can. Remember to
pray for your country during this hour. The Blessed Mother has requested
that Her message be sent throughout the entire world. Please help the
Blessed Virgin Mary to fulfill Her Mission well ... that all souls be
drawn to God and that Jesus will be loved in every heart. This is the
Perpetual song of her Heart. Let it also be ours.

After praying in the spirit (tongues) before the election, the Holy Spirit showed me the following on Barack Obama's presidency..

Despite the effort of displeased Christians to educate other believers that newly president elect U.S. president Barack Obama reportedly stood for partial birth abortion, many were disappointed and even appalled that Barack Obama won the election.

But whether or not these reports are true concerning the president's beliefs, there are other major issues of Obama's election that should be obvious and encouraging as well to the true believer in the power of Jesus Christ and the Holy Spirit.

Nearly every country celebrated the election of the first African American president in U.S history. A phenomenal spark of hope seemed to touch millions throughout the world, and people who don't even live in this country were acting as if they were radically touched and filled with the Holy Spirit, or won a huge lottery jackpot.

Even in America, people of all races, creeds, and colors celebrated into the wee hours of the morning together as the nation has ever witnessed before. From 5 years old to a 106 years old man, people cried, held hands, turned flips, danced, cooked and gave each other pies and cakes, partying themselves into a bliss oblivion this night.

Not since the celebration's and jubilation that nearly every Black American erupted into when O.J. Simpson was acquitted for murder during a nationally broadcast verdict in 1993 has the U.S. seen so many people erupt into a spark of cheers that encouraged hope, justice, and a better life, as the evening when Barack Obama was declared winner in the presidential election. The phenomenon is that this spark of hope expanded it's power outside our national borders to people of all ethnicities around the world.

The Word of God declares that, "These three abide Faith, HOPE, and Love but the greatest of these is Love, and that Hope makes us not ashamed because the "Love of God" is shed abroad in our hearts by the Holy Ghost. Only these attributes according to scripture are eternal entities and always present in the earth and heaven. 1 Corinthians 13:13, Romans 5:4,5

One could say those that celebrated that night essentially showed love for each other so openly as has never been seen before in America's history. Hope is what sparked this Love.

Understand that all Hope comes from God and that there is no such thing as a "false hope." Satan comes not but to (distinctly) steal, kill, and destroy but God made hope and it will always abide and thrive throughout eternity together with faith and love. Hope is not designed to deceive and entice people, but is a genuine, powerful arm of God that is always victorious over adversities and obstacles. John 10:10

Black Americans are a product of the word hope. Where slavery, injustice, racism, and poverty were, hope defeated them soundly, and as a result, "one of their own" is now the president of the United States of America. At 56 years old and a Black man myself, I never thought that I would see the day that a "brother" would win the presidency during my lifetime. Millions of other Blacks, young and old in America ,share this same sentiment.

The irony in this election and complaining by Christians is that since America is considered a Christian nation to date, not one Black man was ever even given the acceptance, encouragement, or support to legitimately compete for this office for 200 years.

Black people have simply not been looked upon as an equal but was blatantly, systematically, and maliciously strategized into the lowest class citizenry in America, simply because of the color of his skin. Of course America does not want people to talk about that because that was the "past". Blacks were even brutally punished for just reading a book or looking at a white person in the eye, yet America was still considered a Christian nation.

Now that more people have the right to vote (younger generation, gays, etc), their collective vote and desire for "hope" aided the landslide win for Obama. Yet, if Christians would have practiced the Word of God in the past, the possibility of a Black man becoming president should have been more possible before the face of America's social structure became so openly rebellious and careless.

Christians never gave a Black man the chance to run for president (and every U.S. president had some major issues in their own lives) when it was in fact primarily a Christian nation. The Christian nation of America had no aspirations to support a Black man as president because it had a "kink" in its kingdom armor. It was not only a racist society but also the nation did not have a revelation in action and deed concerning the Love of God. Segregation and hatred validates this overwhelmingly.

Christians love walk was so empty that if they asked "sinners" to come to their church the person might reply , "Why would you ask me to go to your church? For what? So I can be in bondage like you.", because there certainly was no evidence in their lives that the power of Christ was legitimate.

Now these same that were offended at Christianity are the same people who now have the right to vote and they made the difference in this election. They did not know what Obama believed or even cared. They were just happy that "on the surface" America's bigotry and racism had been defeated, and that if there is hope for a Black man in America (slavery, the criminal justice system, racial profiling, lynching, educational issues, no major corporation owner, economic hardships, etc., etc), there must be hope for themselves also. There are very clever people around the world know the history of America and it's treatment of the Blacks, and they know that every other ethnicity the U.S. has wronged has received reparations, except Blacks in America.

Hopes ever eternal mission is to invite the lost to the only true hope in the world, Jesus Christ.
What to Do:

The Believers mission in this phenomenon of hope that has touched so many millions of lives is to pray (and release by faith in your words) that the hope generated will empower and blossom it's grace upon the hearts of the hopeful with the very substance of hope itself, which is God (Love).
Believers should take their rightful stand and release the substance in that "spark of hope", by speaking, decreeing, and declaring it to the hopeful, and the Grace itself contained within the hope will manifest the anointing of Jesus Christ into the individual lives of all those that have "received" this spark of hope. Mark 11:22,23

Obama may not be the Christian that others want him to be, but the hope that was clearly generated during this election absolutely validates the scripture, "Where sin does abound, Grace does much more." (Obama was a member of Dr. Jeremiah Wright's church in Chicago for 5 years with other celebrities, and if you know anything about Dr. Wright, an anointed, gifted Black Pastor, you know that Obama would not attend there if he did not have a genuine cause for the reality of Jesus Christ)

Hope is a powerful weapon in any form. God is doing something in this election but most professing Christians have no idea what it is. It is called Hope.. It is one of God's most powerful weapons within the atrocities of a self centered, sinned filled world .

The McCain team was tainted with inner turmoil because his choice for vice president did not agree with many of his policies. She even cried when they announced Obama as winner. Our government protects our rights and preserves our freedoms. Governments are set up to make and enforce laws. In the United States there are three levels of government. The federal government ( national level ) makes and enforces laws for our nation. The fifty state governments ( state level ) make and enforce laws for their respective states. The most powerful of the three levels is our federal ( national level ) government.

All nations of the world have some type of government. Not all governments are alike. Regardless of the type of government, its leaders try to justify that amount of power that the government has. There are different ways in which leaders are chosen based on the type of government. There are also varying degrees of power that is held by people in certain types of government.

There are limited governments and unlimited governments in the world. The United States has a constitutional government, which means that it is a limited government system. This prevents leaders from abusing the powers that they have been given. This type of government system provides control over the people that are in authority and protects our individual freedoms.

Many of you know that attorney Phil Berg is filling his appeal in the Superior Court. His case Berg v Obama and DNC stated that according to the statements made by Sarah Obama, the paternal grandmother and other relatives of presidential candidate Barack Obama, he was born in Mombasa, Kenya and not in Hawaii, as he states, which means that he is not a natural born US citizen and therefore ineligible to be the president of the US. Additionally at the age of six, he moved with his mother to Indonesia and his school registration there shows him as an Indonesian citizen. Since Indonesia did not allow dual citizenship at the time, it means that Ann Dunham, Barack Obama’s mother had to relinquish his US citizenship in order to obtain Indonesian citizenship for him.

Federal judge Surrick has noted lack of standing in his decision, which necessitated the appeal to the Supreme Court. According to Judge Surrick, the proper plaintiff will be the congress and not a voter. Considering the fact that the congress is predominantly democratic and is craving to see the Democrat in the white house; the ordinary voters of this country have a better chance of being struck by the lightening, then expecting justice to be upheld and Congress voting to check eligibility of Barack Obama.

This situation has stirred some serious outrage among a large number of voters that decided to seek justice in the State courts, filing legal actions against Secretaries of States, demanding that those Secretaries of States check Obama’s eligibility and check his original birth certificate, that contains the name of the hospital and the name of the doctor and other documents.( the registry of life birth on Obama’s website was issued in 2007 and doesn’t contain much of the information that can be found on the original Birth Certificate from the hospital). 7 legal actions were filed in different states and plaintiffs found out that majority of States are not checking any documents, but rather have the candidates sign a form, where they certify that they are eligible and able to perform the duties of the president.

Hypothetically speaking Osama Bin Laden can sign one of these forms and run for President of the US, nobody would check his birth certificate or any other forms.

Another Lawsuit Filed on Obama’s POTUS Eligibility

Thanks to the lawsuit filed by Philip Berg, Obama now ADMITS (on his “Fight the Smears” website and factcheck.org) that he held dual citizenship with Kenya as a child. This, in and of itself, may arguably disqualify him under Article II as the whole point of the “Natural Born Citizen” requirement is the avoidance of divided allegiances. (Which makes his covert and quite possibly illegal activities [Logan Act?] on behalf of Kenya’s thugocrat, Odinga, all the more relevant and disturbing.)

There is a further complication, however. His subsequent adoption by Lolo Soetoro and resultant INDONESIAN citizenship is a bigger fly in his ointment. (I laugh whenever reference is made to “citizen of the WORLD’… Obama truly is a WORLD CITIZEN!)

Indonesia, at the time Obama lived there and was deemed an Indonesian citizen, did not recognize dual citizenship, and neither did the US recognize dual citizenship with Indonesia. Thus, whether he held dual citizenship with the US and Kenya, whether he was born in the US or Kenya, or even - as some suggest - CANADA, is irrelevant as the ONLY legitimate citizenship he held once his adopted father moved him to Indonesia was Indonesian! His US Citizenship would be forfeit!

Whether and when Barry Soetoro/Barack Obama might have regained US Citizenship thereafter, it would be thru NATURALIZATION and that is SPECIFICALLY and EXPRESSLY ineligible to serve as President of the United States under Title II. (Could this be why he uses the politically risky name Barack Hussein Obama instead of the more innocuous “Barry Soetoro”? Perhaps Barry Soetoro is STILL an Indonesian citizen? The judge in the Berg suit has not, to this date, granted Obama’s motion to dismiss the case and it continues to move forward. (If the case has no merit, why hasn’t the judge granted the relief Obama filed for??) Now Obama has a second suit he must contend with. Both could be easily dispensed with by providing the demanded documentation which would prove he is a “natural born citizen” and thus eligible to serve. He has not produced these documents and instead seeks to DELAY discovery and production of any documents while he makes motions to dismiss. The “proof” of eligibility he’s offered is a “Certificate of Live Birth” posted on his “Fight the Smears” website, and duplicated on Factcheck.org and the Daily Kos sites! (Forensic experts have declared it a forgery!) Even if it were a genuine Hawaiian “Birth Certificate” with raised seal (and it’s not), it would still not adequately address the Indonesian citizenship issue which Obama has yet to acknowledge!

1.1. Plaintiff Steven R Marquis, [hereinafter “Plaintiff”] hereby offers this memorandum in support of his motion for injunctive relief, to demand performance of constitutional duties related to the Office of Washington State, Secretary of State by Samuel Sumner Reed, a/k/a Sam Reed, [hereinafter Defendant”].

1.2. Plaintiff’s complaint challenges the presidential candidate Mr. Barack Obama’s eligibility to run for the Office of President and demands that the Office of Secretary of State make such determination by acquisition of original documentation or by receipt of verifiable information from another government entity so charged with overseeing the election process such as the Federal Elections Commission.

1.3. Plaintive argues that when a challenge is received by the Washington State, Secretary of State to the qualification for office of a candidate appearing on the Washington State Ballot that the entire burden of proof falls on the Candidate for Office to present such information and documentation to the Washington State, Secretary of State as would be normal and customary to establish ones minimum qualifications for office.

1.4. Plaintiff argues that the Office of Secretary of State has the Constitutional and Statutory authority to make such determinations as part of certifying and executing fair and open elections.

1.5. Plaintiff argues that is it only sufficient to show reasonable cause for complaint to the Secretary of State for his Office to require documentation of the respective candidate relevant to determination of minimum qualification; that lacking explicit statute defining the requisite documentation that the Secretary of State has the intrinsic authority to set those reasonable standards that would establish certain confidence in the people in the electoral process.

1.6. Plaintiff seeks focused and expedited review, to protect the veracity of the electoral process and maintain the people’s confidence in the government.

2. COMPLAINT FOR INJUNCTIVE RELIEF - PRELIMINARY STATEMENT

2.1. Article II, Section I of the United States Constitution, states in particular part, “No Person except a natural born citizen, or a citizen of the United States at the time of the adoption of this constitution, shall be eligible to the Office of President; neither shall any person be eligible to that office who shall not have attained to the age of thirty five years, and been fourteen years a resident within the United States.” .

2.2. Mr. Barack H. Obama is a candidate for United States Office of the President. However, Mr. Obama must meet the qualifications specified for the United States Office of the President, which is, he must be a “natural born” citizen. Mr. Obama has failed to demonstrate that he is a “natural born” citizen. There are other legal challenges before the Federal Courts regarding aspects of lost or dual citizenship. That challenge in an of itself further demonstrates plaintiff’s argument that reasonable doubt exists as to the veracity of the electoral process that would allow such fundamental questions exist at this late hour preceding the election.

2.3. The Washington State office of Secretary of State is responsible for the veracity of the Washington State election process from verifying ahead of time the qualification of the voters, the ballots themselves, the candidates and the final counting and certification of results. That office is intended to be non-biased and to provide the critical sense of fairness and correctness necessary for the people to have faith in the fundamental underpinnings of the democratic basis for our republic.

2.4. There is a reasonable and common expectation by the people that to qualify for the ballot that the individuals so listed meet the minimum qualifications as outlined in the constitutions and that proof of those minimum qualifications has been received by the officials executing the election process. Heretofore, only a signed statement from the candidate attesting to meeting those qualifications was requested and received by the Office of the Secretary of State with no verification demanded. This practice, it should be noted, represents a much lower standard than that demanded of one when requesting even a driver’s license. Since the office of Secretary of state has at its core the mission of certifying and establishing the veracity of the election process, this complaint seeks a directive to the Washington State Office of Secretary of State to receive appropriate verifiable documentation and certify any individual’s qualification for Office whose basic credentials for that Office have been challenged by formal request to the Office of Secretary of State from a citizen of Washington State.

2.5. In the case of individuals seeking the Office of President of the United States, the US constitution prescribes a system of electors where citizens of the respective state have a state controlled election wherein electors representing the interest of the named individual on the state ballot are so elected to represent the interests of the respective state at the electoral college. Thus, we do not have a federal ballot controlled by the federal government; we have a Washington State ballot where we elect electors who in turn represent the named individual on the ballot. That is one more reason that the Washington Secretary of State has prevue over the certification of not just the counts of the ballots so cast, but also the veracity of the contents of the ballot.

2.6. This complaint of failure to carry out a key task in our election system could be satisfied should verification of candidate qualifications be received from original or certified documents from primary sources or from a verifiable report generated from government agencies such as the Federal Elections Commission. It is the Washington State, Secretary of State’s duty to certify the veracity of documents or reports so received.

2.7. To avert likely civil unrest and a constitutional crisis which would certainly accrue after the election through laborious legal challenges and impeachment process, this complaint seeks to resolve such complaints prior to the election. It was incumbent on the candidates to present such documentation, but to date Mr. Obama has failed to do so.

2.8. This complaint seeks specifically to verify through the office of the Washington Secretary of State that Mr. Obama is a “natural born” citizen.

2.9. At this point, Mr. Obama has not allowed independent or official access to his birth records and supporting hospital records. Mr. Obama’s citizenship status has and is being challenged in the federal courts which challenge will cast doubt on the veracity of the electoral system regardless of outcome if not resolved prior to the election. The Washington State, Secretary of State Office is specifically charged with certifying and guaranteeing the veracity of official documents and overseeing the elections to wit the people’s confidence in the fundamental aspect of democracy is maintained. To date, in this regard, Secretary of State Sam Red has not carried out that fundamental duty.

2.10. The Federal Elections Commission FEC is generally tasked with providing oversight and verifications of federal candidates. To date the FEC has not produced either certification or verifiable documentation regarding the candidates basic qualifications for office. Lacking that certification from the FEC, this complaint request the Washington State - Secretary of State Sam Reed to formally request of Hawaii State Health Department officials to produce forthwith a certified copy of his “Vault” [original long version] Birth Certificate.

2.11. This complaint requests that Washington State - Secretary of State Sam Reed formally requests primary backup materials if they exist of hospital records that would lend veracity to a Hawaii live birth declaration. A court order of discovery is requested to assist that investigation directed to the respective hospital if so identified on a live birth certificate.

2.12. Should Mr. Obama be discovered, whether by virtue of malfeasance, or negligence, or ignorance on his part to not have a valid certified US birth certificate or to otherwise due to have been revealed by such examination of original records to be ineligible for the Office of President of the United States of America and thereby his nomination be declared void by the appropriate authorities acting under the law, Plaintiff as well as other Americans will suffer irreparable harm including but not limited to:

2.12.1. Functional, or actual, disenfranchisement of large numbers of citizens, being members of the Democratic Party, who would have been deprived of the ability to choose a qualified nominee of their liking;

2.12.2. Irreparable harm to the structure and integrity of the Democratic Party and the Democratic National Committee. In turn, this too would lead to disenfranchisement.

2.12.3. If the candidate Mr. Obama were to secure the election and later be discovered ineligible, the resulting constitutional and national security crisis that would ensue would generate a severe and genuine likelihood of civil disturbance by virtue of reaction to said disenfranchisement and upset.

2.13. It was well expected that after all the public concern that has been raised over the preceding months now that Mr. Obama would have released for public or official scrutiny the relevant documentation to back up his claim of qualification as a “natural born citizen”. His reaction to public concern and his recent actions in Federal District Court 9/24/2008 demonstrate that Mr. Obama has no intentions of releasing said documentation for review or cannot because they do not exist. The late hour of this request was dictated by the delaying tactics of the candidate Mr. Obama, and the non-responsiveness to Plaintiff’s repeated request to the Office Washington State - Secretary of State Sam Reed.

3. JURISDICTION AND VENUE

3.1. As we do not have federal ballot per se, Washington State, through the office of the Washington State, Secretary of State creates its own ballot and supervises the same, electing electors to represent our choice for the Office of President. This case arises under the Washington Constitution RCW 42.04.020 and Section 15, Article III, Section 17 of the Washington State Constitution and Chapter 43.07 RCW. and the laws of the United States and presents a state question within this Court’s jurisdiction.

4. PARTIES

4.1. Plaintiff, Steven Russel Marquis [hereinafter “Plaintiff’], is an adult individual with a home address of 34077 SE 56th St Fall City, WA 98024. Citizen USA.

4.2. Defendant, Samuel Sumner Reed, a/k/a Sam Reed is an adult individual with an office address of PO Box 40220 Olympia, WA 98504-0220. Washington State, Secretary of State.

5. FACTUAL ALLEGATIONS THAT DEMOSTRATE THE NEED TO PROOF THE CANDIDATE’S MINIMUM CONSTITUTIONAL QUALIFICATION.

5.1. These allegations and statements are not intended to be proof of the status of Mr. Obama’s citizenship or lack thereof. That will be determined in the venue of the US District court. The listing of the allegations detailed below are included to demonstrate the reasonable assertion of the need for the Washington State, Secretary of State to reestablish public confidence in the veracity of the electoral process and the obvious need for precertification as to a candidate’s meeting the minimum constitutional requirements.

5.2. By the U.S. Constitution, in order to run for office of the President, you must be a “natural born citizen” and you may not hold dual citizenship or multiple citizenships with foreign countries. U.S. Constitution, Article II, Section 1.

5.3. There are questions as to where Obama was actually born; in the United States or abroad but subsequently registered in Hawaii. There are further questions regarding Obama’s United States citizenship, if he ever held such, being expatriated and his failure to regain his citizenship by taking the oath of allegiance once he turned eighteen (18) years of age. There are additional questions regarding Obama’s multi-citizenships with foreign countries, which he may still maintain. To date, Obama has refused to prove he is qualified under the U.S. Constitution and his eligibility to run as President of the United States despite requests and recent opportunities to do so in Federal Court.

5.4. The “certificate” that Mr. Obama has posted on his official WEB site is a “Certification of Live Birth,” and not a “Birth Certificate” from Hawaii. There is no indication on even this certificate as to specifically where the birth took place.

5.5. Researchers have claimed to have been unable to locate any birthing records in island hospitals for Barak Obama’s mother. Mr. Obama has offered none for review.

5.6. Three forensic document experts have published extensive reports claiming that there is evidence of tampering on even the Obama WEB site displayed certificate.

5.7. Numerous Freedom of Information Requests have been sent to Officials in Hawaii with no response from the public officials nor has Mr. Obama granted access for release of the information lending to the concern over the veracity of the attestation on the candidate’s application for candidacy for the office of President of the United States.

5.8. The facts are undisputed by Obama that his mother, Stanley Ann Dunham, was a U.S. citizen however, his father, Barack Obama, Sr., was a citizen of Kenya. Obama’s parents, according to divorce records, were married on or about February 2, 1961.

5.9. Obama claims he was born in Honolulu, Hawaii on August 4, 1961; however, has never given the name of the hospital he was born in; whereas there are reports that Obama’s grandmother on his father’s side, half brother and half sister claim Mr. Barack H. Obama was born in Kenya. Reports further reflect that Mr. Obama’s mother went to Kenya during her pregnancy. Wayne Madsen, Journalist with Online Journal as a contributing writer and published an article on June 9, 2008 stating that a research team went to Mombassa, Kenya, and located a Certificate Registering the birth of Barack Obama, Jr. at a Kenya Maternity Hospital, to his father, a Kenyan citizen and his mother, a U.S. citizen. There are claims of records of a “registry of birth” for Obama, on or about August 8, 1961 in the public records office in Hawaii, but these have not been released for scrutiny. It is alleged in the Federal trial and is a matter of much general speculation that Mr. Obama’s mother was prevented from boarding a flight from Kenya to Hawaii at her late stage of pregnancy, which apparently was a normal restriction to avoid births during a flight. It is likely that Stanley Ann Dunham (Obama) gave birth to Obama in Kenya, after which she flew to Hawaii and registered Obama’s birth.

5.10. Regarding the alleged birth of Barack Hussein Obama in Honolulu, Hawaii, it is variously circulated that Obama’s birth is reported as occurring at two (2) separate hospitals, Kapiolani Hospital and Queens Hospital. Obama has provided no proof of birth from of either of these or any other US based facility. He has made no effort to address these public concerns.

5.11. There are no published or known hospital birthing records for Stanley Ann Dunham (Obama), Obama’s mother. There are only claims of records of a “registry of birth” for Obama, on or about August 8, 1961 in the public records office in Hawaii.

5.12. There is even a Canadian Birth Certificate posted on the Internet in the name of Barack Hussein Obama, Jr.; however, the date of birth shows to be August 23, 1961

5.13. At the time of Obama’s birth in 1961, Kenya was a British Colony. Subsequently, under the Independence Constitution of Kenya, Mr. Barack H. Obama became a Kenyan citizen on December 12, 1963. There are no indications or reports that Mr. Obama ever renounced that dual citizenship conferred either by nature of birth or by virtue of his father’s Kenyan citizenship. On Mr. Obama’s Senate web site, Mr. Obama acknowledges his father holds Kenyan nationality but avoids addressing that that he (Mr. Obama) also held/holds Kenyan nationality.

5.14. If in fact Obama was born in Kenya, the laws on the books in the United States at the time of his birth stated if a child is born abroad and one parent was a U.S. Citizen, which would have been his mother, Stanley Ann Dunham, Obama’s mother would have had to live ten (10) years in the United States, five (5) of which were after the age of fourteen (14). At the time of Obama’s birth, his mother was only eighteen (18) and therefore did not meet the residency requirements under the law to give her son (Obama) U.S. Citizenship much less the status of “natural born.” The laws in effect at the time of Obama’s birth prevented U.S. Citizenship at birth of children born abroad to a U.S. Citizen parent and a non-citizen parent, if the citizen parent was under the age of nineteen (19) at the time of the birth of the child. Obama’s mother did not qualify under the law on the books to register Obama as a “natural born” citizen. Section 301(a)(7) of the Immigration and Nationality Act of June 27,1952,66 Stat. 163, 235, 8 U.S.c. §1401(b), Matter of S-F-and G-, 2 I & N Dec. 182 (B.I.A.) approved (Att’y Gen. 1944). Obama would have only been Naturalized and a Naturalized citizen is not qualified nor eligible to run for Office of the President. U.S. Constitution, Article II, Section Clause 4.

5.15. Furthermore, if Obama had been born in Kenya, his birth father Barack Obama, Sr. was a citizen of Kenya; therefore, Obama would have automatically become a citizen of Kenya.

5.16. The Nationality Act of 1940 provided for the loss of citizenship when the person became naturalized upon the naturalization of his or her parent having custody of such person. Obama’s mother expatriated her U.S. Citizenship when she married Lolo Soetoro, a citizen of Indonesia and relocated herself and her son (Obama) to Indonesia.

5.17. Obama was enrolled by his parents in a public school, Fransiskus Assisi School in Jakarta, Indonesia. Plaintiff has available copies of the school registration where it clearly states Obama’s name as Barry Soetoro and lists his citizenship as Indonesian, Obama’s father is listed as Lolo Soetoro, Obama’s date of birth and place of birth are listed as August 4,1961 in Honolulu and Obama’s Religion is listed as Islam. This document was verified by television show Inside Edition, whose reporter, Matt Meagher took the actual footage of the school record.

5.18. In or about 1971, Obama’s mother sent Obama back to Hawaii. Obama was ten (10) years of age upon his return to Hawaii.

5.19. Sometime after the return of Obama to Hawaii, Obama’s mother, Stanley Ann Dunham returned to Hawaii and divorced her husband, Lolo Soetoro. At the time of divorce, Obama’s mother, Stanley Ann Dunham could have regained her U.S. citizenship. In order to regain her citizenship, Obama’s mother would have had to take the oath of allegiance required. Such oath of allegiance may be taken abroad before a diplomatic or consular of the United States, or in the United States before the Attorney General or the judge or clerk of a court. Such Oath of Allegiance would have been entered in the records of the appropriate embassy, legation, consulate, court or the Attorney General and upon demand, a certified copy of the proceedings, including a copy of the oath administered, under the seal of the embassy, legation, consulate, court or the Attorney General shall be delivered. The certified copy shall be evidence of the facts stated therein before any court of record or judicial tribunal and in any department or agency of the Government of the United States. 8U.S.c.§1435.

5.20. Obama’s mother failed to take the oath in order to regain her U.S. Citizenship. Therefore, Obama would not have been able to regain his U.S. Citizenship until he turned eighteen (18) years and then only after he took the Oath of Allegiance before a diplomatic or consular officer of the United States, or in the U.S. before the Attorney General or the judge or clerk of court. Since the Oath of Allegiance would have been entered in the records of the appropriate embassy, legation, consulate, court or the Attorney General, then Obama should be able to produce in court a certified copy of the proceedings, including a copy of the oath administered. No such copy has been to date produced for public examination.

5.21. After many attempts of the public to obtain Obama’s Certificate of Birth, a Hawaiian Certificate of Live Birth (COLB) was placed on Obama’s campaign website. However, as posted all over the internet, three (3) independent Document Forensic Experts performed extensive forensic testing on the Certificate of Live Birth as posted on Obama’s campaign website. The Forensic Expert findings were that the posted Certificate of Live Birth (COLB) was a forgery. It was further discovered that the posted COLB had evidence of having been created from an altered/forged from a COLB issued to Maya Kasandra Soetoro, born in 1970. Maya Kasandra Soetoro is Obama’s half sister who was born in Indonesia and her birth was later registered in Hawaii. The altered and allegedly forged COLB is still on Obama’s website located at http://my.barackobama.com/page/invite/birthcert

5.22. Even if Obama had and subsequently maintained his United States Citizenship, which citizenship he has failed before District Court to demonstrate, he may still carry citizenships in Kenya and/or Indonesia. These facts call into question what the constitution attempted to address regarding potently divided loyalties with foreign countries. Thus, Mr. Obama carries multiple citizenships and would be ineligible to run for President of the United States. United States Constitution, Article II, Section 1.

6. Failure to grant injunctive relief will realize these detriments:

6.1. Failing to officially and publically vet the status of the citizenship claims of Mr. Obama will cast a pall of doubt on the election process and taint the election results themselves.

6.2. Failure to grant injunctive relief would allow a potentially corrupted, fraudulent nomination and election process to continue.

6.3. Failure to grant injunctive relief demanding the Washington State, Secretary of State certify the minimum qualifications of challenged candidates not only allows, but promotes an overwhelming degree of disrespect and creates such a lack of confidence in voters of the primary and electoral process itself, so that it would cement a prevailing belief that no potential candidate has to obey the laws of this country, respect our election process, follow the Constitution, or even suffer any consequence for lying and defrauding voters to get onto the ballot when they have no chance of serving if they fraudulently manage to get elected.

6.4. As stated above, Plaintiff as well as all American citizens will suffer irreparable harm if injunctive relief is not granted. Plaintiff does not have any other way of redress regarding these very significant and important issues.

6.5. Despite many complaints, the FEC has failed Plaintiff and the American citizens by their failure to date to perform due diligence and inquire into Mr. Obama’s eligibility to run for Office of the President. Lacking such certification, it is incumbent on the Washington State, Secretary of State to certify or decertify as to the eligibility for office before the election based on the availability of clear documentation demonstrating that minimum qualifications for the respective office has been met by candidates.

7. WHEREFORE, Plaintiff respectfully prays that this Court:

7.1. Grant injunctive relief demanding that Washington State, Secretary of State Sam Reed immediately acquire primary documents or certified copies from primary sources such as Health Department and hospital records or verifiable reports regarding same from the FEC.

7.2. Plaintiff requests Washington State, Secretary of State Sam Reed to immediately demand such verifiable report from the FEC or demand a certified copy of Obama’s Certificate of Live Birth and subpoena as needed for the release hospital records if so claimed on said Live Birth Certificate to further prove he was born in Hawaii as Mr. Obama claims.

7.3. Direct Washington State, Secretary of State Sam Reed to certify or decertify the challenged candidates prior to the election based on the availability of clear documentation.

7.4. Plaintiff requests the Washington State, Secretary of State to immediately demand a certified copy of Obama’s Oath of Allegiance proving he regained his United States Citizenship.

7.5. If Secretary Sam Reed is unable to document a certified record of Obama’s oath of allegiance and birth and hospital records, Secretary of State Sam Reed must decertify Mr. Obama as a valid candidate for the office of President of the United States Office of the President under the United States Constitution, Article II, Section I;

7.6. Award Plaintiff such costs and fees applicable by law; and further relief as the Court deems just and proper.

However, as Media Matters for America has documented, the Obama campaign posted a copy of Obama's birth certificate on its "Fight the Smears" website and reportedly provided the original document to FactCheck.org, whose staff concluded in an August 21 post that it "meets all of the requirements from the State Department for proving U.S. citizenship." A Hawaiian Health Department official also reportedly confirmed to PolitiFact.com that Obama's birth certificate is valid, and even Corsi's employer, the right-wing website WorldNetDaily, reported in an August 23 article that a "WND investigation into Obama's birth certificate utilizing forgery experts also found the document to be authentic."

On the October 23 broadcast of his radio show, Limbaugh said:

Who announces days in advance they're rushing to the side of a loved one who is deathly ill, but keeps campaigning in a race that's said to be over, only to go to the loved one's side days later? See, I think this is about something else. You know what's really percolating out there? And I've been laying low on this because it just -- it hasn't met the threshold to pass the smell test on this program. But this birth certificate business, this lawsuit that a guy named Phillip Berg filed in Philadelphia in August for Obama to produce his genuine birth certificate, and he still hasn't replied, he hasn't done so.

Limbaugh later added:

When you first announced this, you're gonna rush, you're gonna hurry, you're gonna make tracks, you're gonna get over there because you don't want your grandmother to die before you got there like your mother did, but somehow you keep campaigning, you take three days to get over there, if he's left yet. And this birth certificate business -- I'm just wondering if something's up. I have no clue, and I -- folks, I'm telling you, this has not reached the threshold until now, and it's now popping up all over the place.

During an appearance on the October 22 broadcast of Liddy's radio show, Corsi said:

I'm headed out to Honolulu. I am not convinced that Barack Obama is going because his grandmother is sick. I appreciate that his grandmother is sick and he wants to be with her. I do recall that Barack Obama's mother died of cancer, and he didn't go to be by her side when she died. He relates that in his autobiography, Dreams From My Father. And I'm going out to do what digging I can on the birth certificate.

Corsi later added:

I think I'll accomplish something in Hawaii, too. Obama's headed out there, and I believe there's a court challenge that if Obama does not dodge, he's gonna be forced to produce a birth certificate, and there's gonna be something damaging on that birth certificate, because even at the eleventh hour, Obama refuses to show us the hospital-generated birth certificate when he was born.

As Media Matters has noted, Corsi has previously claimed that the Obama campaign "refuses to release the original birth certificate," even though WorldNetDaily -- where Corsi works as a staff writer -- has debunked the claim.

On the October 22 broadcast of his nationally syndicated radio show, Savage stated that "[t]here are people arguing that Obama is headed back to Hawaii not so much to visit an ailing relative, but to fudge the birth certificate in question" and said moments later, "There is intense national interest on the Internet about his citizenship, and the question is being asked, could this be the real reason he is headed to Hawaii?" Savage subsequently became more definitive, stating:

Do you actually believe he's going to Hawaii to visit his ailing grandmother with 10 days to go until an election? Do you actually believe that? Do you actually believe he'd be going to Hawaii at this time with 10 days to go? You actually believe that? No, no, no -- no, no, no, no, no. No. There's some other reason that he's leaving the mainland of the United States in the midst of this toe-to-toe struggle right now, and it's got to do with his birth certificate.

He later added: "And Obama's leaving for Hawaii -- why? Why? What's he doing there? Why's he going there, huh? What's he going there for, huh? Why's he gonna -- the last phase of a race, he's getting off the track just to visit his grandmother? Don't be stupid. It's the birth certificate issue, you fools, you."

Savage also directed people to his website to "look at the birth certificate and judge for yourself on MichaelSavage.com. We actually have the birth certificate submitted by the Obama camp, and it looks like it's fake." Savage's website currently has a copy of the birth certificate Obama has posted on its "Fight the Smears" website along with a headline stating "Could this be the REAL reason Obama is heading to Hawaii?" The headline links to a post by Andy Martin on Martin's Contrarian Commentary website. Martin stated in an October 20 press release: "Monday (today) we petitioned the Hawai'i Supreme Court to order Obama's secret birth records released. How did Obama respond? He suddenly discovered that his grandmother, who had supposedly been released from her hospital a week ago, when he showed no interest in her, needed his immediate attention. Cool, calm, collected Obama suddenly suspended his campaign and headed for Hawai'i."

(HONOLULU, HI)(October 22, 2008) Internet powerhouse Andy Martin told a Honolulu news conference today that after an intense international investigation he is convinced that Barack Obama, Junior, the presidential candidate is really the son of Obama’s controversial mentor Frank Marshall Davis.

“Mendacious adults ‘switched’ Obama at birth. That is why he has refused to allow access to the original or ‘vault’ birth certificate,” Martin told a Honolulu news conference. “We believe the original certificate did not list a father. Barack Obama became the father as a result of an agreement between Ann Dunham, Frank Marshall Davis and Barack Obama, Sr.

“Davis was already married to a White Woman. He did not need a nonmarital child by a second one. Ann probably refused to have what was then called a ‘back alley’ abortion. Davis may have felt that ‘Obama’ would face less stigma with an ‘African’ background than a Negro one. The civil rights revolution, of course, turned that gambit upside down. In discovering and understanding what happened we cannot forget we are dealing with events in 1961, not 2008.

“The irony in all of this is that Obama once stated he did not want his daughters to be ‘victimized’ with a child. And he is alive because his mother took the contrary view.

“Barack Obama has known this since adulthood, and the shock of this discovery still reverberates in his psyche.

“Ironically, what I have to say today dilutes the ‘Muslim’ theory that has propagated. Davis was not a Muslim. If Obama had told the truth at some point in his life, instead of living endlessly with the lies that were imposed on him by the adults in his life, we would have avoided a great deal of confusion. I, for one, have deep compassion for Mr. Obama. He is not the first person in history to be caught up in this kind of family fraud.

“The disclosure by the two women in his life that he was not the ‘son’ of his ‘father’ also explains why he manifests such extreme ambivalence to both his mother and grandmother. He is angry because he was cheated of his real father.

“Obama was robbed of his birthright of being the son of civil rights royalty, and of a father with whom he was completely simpatico. He could have grown up the son of Frank Marshall Davis, civil rights pioneer and activist, cutting-edge journalist, poet and man of letters. Mr. Davis was an extraordinary man in a dark period of this nation’s history, the pre-dawn of the civil rights era.

“Obama has probably suspended his campaign and is flying to Honolulu because he is deathly afraid his grandmother may make a ‘dying declaration’ and blow the whistle on his family fraud. Dying people often blurt out the truth. The true facts of Obama’s parentage also reflect why there has been so much tension and alienation, as well as genuine love, in Obama’s relationship with his grandmother.

“There has been a great deal of confusion and misconception about Frank Marshall Davis. A brief history lesson is essential to understanding the bizarre facts of Obama’s provenance.

“During the 1920’s and 30’s many Negros (African-Americans) became ‘communists’ because the Soviet Union and the Communist Party USA promised to end racial segregation and Jim Crow laws in the United States. The Democratic Party, of course, was the powerful force behind segregation and Jim Crow. So it is a twist of fate that the same party that oppressed Blacks has now nominated one for president.

“Madelyn Dunham is the last surviving person who knows the truth about the switch. That is why as we closed in on Dunham, Obama went ballistic, cancelled his campaign and came to Hawai’i to head us off.

“I actually carry an official, certified pocket-sized birth certificate on me at all times [Andy shows a copy to media]. But this is NOT my ‘birth certificate.’ The original certificate is held in the City Clerk's vault in Middletown, Connecticut. That is what has come to be known as the 'vault copy.'

“Likewise, the document that Obama has plastered over the Internet is NOT his original birth certificate or even a copy of his original certificate. It is a computer generated facsimile of an official record and nothing more. The original certificate was either handwritten or typewritten, not computer-generated in 1961. No one has ever seen that original certificate except the people that are working so hard to keep it hidden from the American people.

“I am asking Judge Ayabe to impound the value certificate and have the court hold it for safekeeping.

“By the time Barack Obama learned who he was, it was too late to change his identity. He was who he was, so he continued the ruse of being the son of an ‘African herder,’ which was yet another lie. ‘Dreams From My Father’ bears no connection to dreams from Barack Obama; there were none. It was Frank Marshall Davis who communicated his dreams to his secret son.

“There is a simple way for Obama to resolve this controversy: he can either admit the truth of these facts and order the immediate release of his vault certificate; or he can submit to a DNA test. We can conduct a Maury Povich-style DNA test to determine filiation between Obama and his brothers, one of whom blogs at BarackObama.com.

“In closing, I can only say that we used the fictional ‘Hawai’i Five-O’ as our dramatic template for this investigative operation. We could have as easily used the great, real-life Hawai’i detective Chang Apana as our polestar. He was featured in yesterday’s newspaper.

“As for Mr. Obama, all I can say is ‘Book’em Danno.” Case solved. Barack Obama the presidential candidate is the son of Frank Marshall Davis.” Martin stated.

“I bear Mr. Obama no ill will and no animus. I have only been a faithful servant of the search for truth, and I believe we finally know the secret truths about who Barack Obama really is: the son of Frank Marshall Davis.”

HIS GRANDMOTHER’S STRANGE SILENCE IS THE KEY TO UNLOCKING THE MYSTERY OF BARACK OBAMA

(HONOLULU, HI)(October 21, 2008) Where his white grandmother is concerned, Barack Obama talks the talk but he does not walk the walk. The presence of our investigative team in Honolulu, the first media investigation of Obama’s Hawai’i heritage in the entire presidential campaign, triggered panic attacks in Obama's organization. Obama has suspended his campaign and plans to arrive in Hawai’i Thursday in a desperate attempt to blunt the thrust of our reporting.

We have called all of this rigmarole a “High Noon”-style Hollywood drama with good reason. By some strange karma, after our team landed in Honolulu to investigate Obama, he decided to make an emergency trip to the island, as if grasping one final time to control the inner pain and secrets that have defined his life.

With all due respect to the senator, while his grandmother may be ill, the claim that he is returning to Hawaii and suspending his campaign on that basis is a ruse to cover the more serious question of how he is trying to deal with the issues we have uncovered.

In this three-part series we strip away the media halo to expose who Barack Obama really is, and who he is not (Part One has been postponed to October 27th).

When we board the airliner for the mainland, the secrets that Barack Obama and his family have maintained for almost a half a century will be no more. The truth will have finally been brought to the surface.

Granny Dunham, Madelyn Dunham, Obama’s white grandmother, was the key to triggering our search for the secret truths.

Ironically, my role as an investigator will also prove to have been transformed into that of a liberator. Barack Obama will be “free at last.”

My book, Obama: The Man Behind the Mask, closes at pp. 415-417 with criticism of Obama’s false claim that he comes from a family of “strong values.” Rather than a strong family, Obama comes from a dysfunctional family that has scarred his existence to this day. The key to understanding this dysfunction is Obama’s grandmother.

When Newsmax.com and I focused attention on Obama’s “imprisoned white grandmother” in 2007, Obama unleashed his tax-exempt attack dogs to smear both me and Newsmax. One of my readers recently suggested that when it comes to bombing runs, “The flack is heaviest over the target.” That has been the case with reporting about Obama’s last white relative. Obama has defended Festung Obama with every device at his disposal.

In this column I try to explain the peculiarities of the Obama-Dunham family in terms that anyone and everyone can understand: family photos, meetings, exchanges. The day-to-day existence of loving relationships, and the significance of their absence.

This is not a happy column. One of my readers today said she “hated” Obama. I responded I had no hatred for Obama. I certainly have no hatred for the tens of millions of Americans who will be disappointed by the revelation of Obama’s charade. Still, the truth must be known so that people can make an informed, if ultimately unfortunate and probably emotional, decision on whom they want as a leader.

Obama’s grandmother has lived in the same apartment for approximately forty years. Last summer at the Saddleback Forum, she was described by her grandson as a “very grounded, common-sense, no-fuss, no-frills kind of person.” Indeed she is. Obama told David Letterman that his grandmother was as “sharp as a tack.” Ouch.

Obama’s grandmother still calls him “Barry.” With good reason she has never accepted the African mumbo-jumbo that Obama adopted as a teenager, when he transformed himself from Barry into Barack. Grandmother still knows him by his real name. There is no pretense in her. It must be unnerving to the “Big Man” to be called by his little name.

But now the strange part. The peculiar part is made even more so by the fact that in a one-in-a-million happenstance, our long-planned investigation in Hawai’i coincided with and may have been triggered by Obama’s sudden and seemingly desperate return to his home town to staunch the impact of our inquiries.

The result of Obama’s sudden change of plans: His picture hugging his grandmother appeared on the front page of both local newspapers today (October 21st).

The picture was almost thirty years old.

The Honolulu Advertiser also used a picture of Obama and his grandmother that was 25 years old. The 25 year-old snapshot was provided to the media by Obama himself. He has nothing more current of the two of them together.

Obama professes absolute love and devotion to his "Toot,” but the two have apparently not taken a picture together in a quarter of a century. That's a very bizarre presidential photo album.

I accept that Mrs. Dunham is in bad health. My own mother is 91, and I know that with age comes infirmity. I also recognize that osteoporosis is a serious illness among the elderly, and especially among elderly women. But I am not aware that osteoporosis has ever been a pretext to live life as a recluse and to decline to participate in the ebb and flow of routine family activity such as picture-taking. What about the great-granddaughters? Do they have any pictures with their great-grandmother? None have surfaced.

Why has Madelyn Dunham not appeared in a photograph with her grandson for a quarter century?

There is a mutual anger and hostility and frustration between them. Almost all of us have similar difficulties in our lives. We may love, but still be estranged from a parent or sibling. We may have deep devotion to a relative, but still disapprove of their lifestyle or choices.

Obama’s family has been torn apart by the lies they could not confront and the truths they could not accept.

Granny Dunham is the keeper of the family secrets. And she does not approve of those secrets. That is why there has been a chasm between Obama and the first two women in his life, his mother and his grandmother. They nurtured him and, in his eyes, they also devastated him. They made him a strong young man, and then they sapped his psyche.

Obama has constructed an elaborate facade, a Maginot Line of emotional defenses, a “Mask,” to cover his sense of helplessness and powerlessness. His “cool” demeanor is a function of an attempt to insulate himself from his own emotions, confusion and sense of inadequacy, instead of being a demonstration of genuine self-confidence.

From the two women who nurtured Barack Obama, and in his eyes, ultimately betrayed him, we turn to the current family situation.

Obama has two daughters. He has a wife. Does he ever. But when he went to visit his grandmother a few months ago, he went alone. Has anyone ever heard of a family where the great-granddaughters do not visit their great-grandmother? And are not full of excitement at doing so?

Osteo may be a painful illness but it is not a totally disabling one. Obama’s own campaign advertisement shows his grandmother’s voice is strong. Why wouldn’t Barack want to bring his daughters to visit their great-grandmother? Race, perhaps?

Other than the single published visitation, there is no evidence that the Obama family spent any significant time with their grandmother/great grandmother. Does Michelle not want her daughters to know their true heritage? Is she still militant inside, while maintaining her own mask of friendliness on the outside?

Once again, we see in Barack Obama the pattern of a dysfunctional family tearing itself apart by struggles over identity and continuity, all of which now extend into the second generation.

Obama claims his grandmother is sufficiently ill to suspend his campaign. Are his daughters joining him in Honolulu if their great-grandma is so ill? Surely a gravely ill relative would be a basis to miss a day or two of school.

The issue of his grandmother’s osteoporosis has been used by Obama as a pretext for Madelyn Dunham’s reclusiveness over the decades. But even someone suffering from Osteo can maintain a normal life. The Kennedy Family exhibited Rose Kennedy well into her nineties, long after she was restricted to a wheelchair. Why is Obama’s grandmother so unwilling to be photographed or appear in public with her grandson? Illness? Nonsense.

I always return, as anyone with a normal family would, to the absence of any photograph between the pair during the past quarter century. That is a very strange state of affairs. Barack Obama is running for president of the United States and the local newspapers in his home town are using high school and college graduation pictures to depict him with his last surviving Hawai’i relative. Yes, there is both love and estrangement between Obama and his grandmother.

What is the basis of this chasm? Why did I find this silence so significant that it triggered a deeper investigation?

Here are my conclusions. When Obama learned the secret truths about his life he was devastated. I am still not sure whether he learned them from his mother or his grandmother. But the shock of the secret truths stunned him. He is still, today, in a state of shock, a state of permanent denial, a state of complete shut down and inability to deal with the truth. “Cool” covers pain.

Obama’s shock at the revelation of his family secrets triggered anger. That anger is still there today. The anger was there when he dealt with the loss of his mother. The anger does not manifest itself in physical terms, but rather in deep emotional estrangement and insularity from those closest to him who he feels betrayed him.

Obama’s grandmother has responded in her own Midwestern way for the past quarter century. She has not appeared in public with her grandson. She is a phantom. The lack of any appearance is an ultimate form of denial and rejection. Who among us would want to endure a parent or grandparent who refused to appear in a family photograph? Madelyn Dunham was approximately sixty years old when she was last photographed. She certainly showed no signs of the immobility then that Obama attributes to her today. Twenty-five years is a long time between family pictures. The absence is telling, devastating, a state of permanent standoff and denial, a modern indication of significance comparable to Sherlock Holmes’ dog that didn’t bark.

Wednesday we will finally disclose the secret truths.

I want to stress that we are still investigating, still digging, still searching for every scrap of evidence we can find. But we are absolutely convinced we have found the larger truth that has defined Barack Obama’s adult life. We have found why Obama can manifest such . an extreme degree of ambivalence, expressing pride and affection for his grandmother on one hand, and casual disinterest on the other. We have found the secret truths about Barack Obama.

Why is Barack Obama delaying his arrival in Honolulu?

Could it be because Andy Martin is there, and Obama is waiting for Martin’s departure before The Chosen One lands?

(HONOLULU, HI)(October 21, 2008) This column is just a short response to Barack Obama’s strange behavior. We will have a full column (Part Two) later today after lunch. (Remember we are on Hawai’i time, so the columns come out much later on the mainland.)

Obama suddenly announced Monday his grandmother had been gravely ill for weeks. He has his own plane. All he had to do is tell the pilot to file a flight plan for Honolulu and take off. He’s the king of his own armada.

But instead of rushing to his grandmother’s bedside, Obama is waiting until I leave Honolulu before he lands.

Ask yourself, “What would I do?” What would you do if you had your own plane and mom or dad suddenly took ill? Would you tell the pilot to set course for Hawai’i, or tell him to wait three (3!) days before coming to your relative’s bedside? How sick is she if Obama is will to delay his “emergency” for three days?

This entire episode is becoming curiouser and curiouser.

If his grandmother is sick enough to suspend his campaign, why is he “suspending” it days late? Curiouser and curiouser.

Last night I was out doing interviews that had to be postponed because of Hawai’i Supreme Court litigation during the day. My cell phone kept ringing with people wanting to alert me, and warn me of possible harm from Obama with his imminent arrival here. I do not believe Obama, or even his more rabid supporters, will try to cause me physical harm. They are too busy measuring for carpet and drapes in the White House.

But I do believe there is a powerful awareness on Obama’s part that I have been pursuing his lies for four years, and we are closing in on his secret truths. The negative karma must be overwhelming. The thief always knows when he is about to be caught. (“Book’em, Danno?”)

No one (except the groveling mainstream media) seems to believe Obama’s grandmother is so ill that, in light of their past relationship, she merited a campaign suspension (more on that later today).

Strange as it seems to me, we are apparently getting to Obama, and he is increasingly afraid of the David in this David and Goliath (Obama) drama.

Is Obama trying to avoid me? (We leave Honolulu Wednesday night and he arrives “Thursday.”) You be the judge.

EMERGENCY PETITION FOR WRIT OF MANDAMUS

INTRODUCTION AND PRELIMINARY STATEMENT

The question of the authenticity and public availability of the birth certificate of Senator Barack Obama (hereinafter “Obama”) has become a source of increasing embarrassment for Hawai’i Government.
Although Obama has purportedly posted a copy of his birth certificate on his own web site, and others claim to have posted other versions, Obama refuses to allow public access to the official records of the State of Hawaii.
Petitioner is an author and columnist who came to Hawai’i to do research on Obama’s years in Hawai’i. After arriving in Honolulu, Petitioner decided he needed a copy of the original birth certificate, as well as any official files relating to the issuance of said certificate.
The Executive Branch Department of Health has repeatedly and egregiously mischaracterized the Hawai’i statute governing access to birth certificates, and did so again on October 17th in a statement to the Honolulu Advertiser.
Petitioner applies to this Court for an appropriate writ, and offers two separate avenues of potential relief for the Court to consider.

I.
JURISDICTION

This court has jurisdiction of this Petition pursuant to HRS § 602-5 (a)(3).

II.
FACTUAL ALLEGATIONS

1. The Petitioner
Petitioner Andy Martin has been writing about Obama for over four years. Petitioner is the author of the best selling book “Obama: The Man Behind The Mask.”
Petitioner publishes an Internet newspaper, http://ContrarianCommentary.com, as well as related blogs, http://Contrariancommentary.wordpress.com and http://ContrarianCommentary.blogspot.com.
Although Petitioner is not a practicing attorney, he is a respected public interest and consumer rights litigator, see http://www.AndyMartin.com. He holds a Juris Doctor degree from the University of Illinois College of Law.
For example, in 2003 the Pennsylvania Supreme Court granted Petitioner special leave of court to represent a U.S. Marine in a landmark case arising under the Soldiers and Sailors Civil Relief Act of 1940, see http://www.firstrespondersonline.us/director.htm (see attached).
Petitioner is also highly controversial. His corruption-fighting efforts in the Illinois courts and federal courts have provoked intense hostility and counter-reactions from judges who were the targets of his exposures see http://www.AndyMartin.com. These judges have sought to vilify and demonize petitioner, and Obama has sought to use these corrupt techniques to divert attention from Obama’s own questionable personal history.
Petitioner is undaunted.
In Hawai’i, petitioner is accompanied by a network television camera crew. Thus the bona fide news value of his current litigation activity is not subject to question.
2. The Respondents
A. Respondent Linda Lingle is named in her official capacity as Governor and Chief Executive of the Executive Branch of Hawai’i government.
B. Respondent Dr. Chiyome Fukino is joined in her official capacity as Director of the Hawai’i Department of Health.
C. The Hon. Bert Ayabe is named in his official capacity as a Circuit Judge of the First Circuit. As will be shown below, Judge Ayabe’s joinder in this petition does not necessarily involve any criticism of the judge and reflects the absence of any local rules to govern the judge’s authority.
3. The birth certificate (certificate of live birth)
A. For the convenience of this court, Petitioner has submitted a copy of the Circuit Court proceedings as a separate Appendix. Those documents are incorporated by reference in this petition.
B. In summary, Petitioner applied for and was denied a copy of Obama’s birth certificate. Petitioner then commenced a proceeding in the First Circuit on October 17, 2008 while still physically present in Honolulu.
C. Petitioner notified Judge Ayabe of Petitioner’s limited availability in Hawaii, and requested or suggested an emergency hearing.
D. Judge Ayabe responded promptly through his judicial assistant with a hearing date after the 2008 election on November 7th. Petitioner was also notified that in order to exercise his rights and pursue his petition he would have to return from Chicago to Honolulu, as there was no provision for telephone hearings. (It was not clear whether the judge viewed the absence of telephone rules as a preclusion of telephone hearings, or was imposing his own individual rules of practice).
E. Petitioner was required to file his lawsuit in Hawai’i. No other court system has jurisdiction of local Hawai’i officials. Petitioner should be as welcome in the Hawai’i court system as a Hawai’i citizen would be on the mainland. There are no artificial boundaries or distinctions under the Privileges and Immunities Clause of the U. S. Constitution. If Petitioner must be present in Hawai’i in order to vindicate rights and remedies under the Hawai’i Constitution and statutes he will be precluded from doing so.
F. Hawai’i is a sophisticated international business center. It is simply impractical for parties to be physically present in the State as a precondition of access to Hawai’i government or the judicial system.
G. Rule 11 of the Probate Rules provides for “Telephone Conference Call Hearings.” On information and belief there is no parallel provision in the Civil Rules.
H. Petitioner remains present in Hawai’i through October 22nd and available for emergency hearings in person.
I. This Court can take its own judicial or official notice that numerous state and federal court systems provide for telephonic participation, see e.g. Florida Rules of Judicial Administration 2.530.

III.
RELIEF REQUESTED

This Court can deal with this petition by either one of two separate approaches.
First, the Court could decide that the Executive Branch’s misapplication and misinterpretation of the relevant statute (see Exhibit 1 to the Circuit Court Complaint) raises issues of sufficiently great public and national importance that the Court will entertain the issues presented as a matter of the exercise of this Court’s original jurisdiction. In that case the writ of mandamus, if granted, would issue directly to the executive branch and Judge Ayabe’s role would become moot and coram non judice.
Second, this Court could decide that the Circuit Court should conduct an expedited hearing, and do so either while Petitioner is still physically present in Hawai’i or while Petitioner is allowed to participate on the telephone, directing that the Circuit Judge either schedule a prompt hearing or ask that the case be reassigned to a judge who can conduct a hearing before the 2008 election. In that case the writ, if granted, would issue to the Circuit Judge.
The approach which this Court prefers to adopt is entirely at the discretion of the tribunal.

IV.
BASIS FOR GRANTING RELIEF

A. The constitutional issue
In Elrod v. Burns, 427 U.S. 347, 373, 96 S. Ct. 2673, (1976) the Supreme Court stated “The loss of First Amendment freedoms, for even minimal periods of time, unquestionably constitutes irreparable injury.” The authenticity and contents of a presidential candidate’s birth certificate is at the apex of First Amendment concerns, Monitor Patriot v. Roy, 401 U.S. 265, 91 S.Ct. 621 (1971)(“[I]t can hardly be doubted that the constitutional guarantee has its fullest and most urgent application precisely to the conduct of campaigns for political office.”)
To say that a proceeding will not be convened until after the election is to create the very type of unconstitutional delay precluded by Elrod, and creates a justifiable public suspicion of a conspiracy and cover-up by Hawai’i officials.
Elrod does not appear to have been cited by any Hawai’i court but has been cited numerous times by federal judges in Honolulu, see e.g. Rapp v. Disciplinary Board, 916 F. Supp. 1525, 1539 (D. Hawai’i 1996); Walsh v. Honolulu, 423 F.Supp.2d 1094, 1108 (D. Hawai’i 2006); Swanson v. University, 269 F. Supp. 1252, 1260 (D. Hawai’i 2003); Legal Aid v. Legal Services, 961 F. Supp. 1402, 1417 (D. Hawai’i 1997). Although Petitioner filed his Circuit Court lawsuit under the Hawai’i Constitution and not the First Amendment, this Court has previously interpreted those rights to be coextensive.
B. The procedural issue
There is an anomaly under Hawai’i procedure where probate rules provide for telephone hearings but civil rules do not. Perhaps this gap motivated the circuit judge to deny a hearing, or to adhere to such procedures as a general practice.
Certainly in the modern commercial age, with Hawai’i at the crossroads of international business, antiquated notions of physical presence as a precondition for access to Hawai’i government should be reconsidered. The Privileges and Immunities Clause of the U.S. Constitution would also appear to lean in favor of allowing out-of-state litigants from the mainland to be heard by telephone.
C. The substantive issue
a. The statute
HRS § 338-18 (b) limits disclosure of records to persons having “a direct and tangible interest in the record.” The statute then provides thirteen (13) examples as illustrative, but not exclusive, including number (9): “A person whose right to inspect or obtain a certified copy of the record is established by an order of a court of competent jurisdiction.”
The Respondents have steadfastly misinterpreted the “direct and tangible interest” standard into one requiring a direct and tangible “relationship” between the party and the record. Thus there is a serious abuse of discretion and statutory misinterpretation by the executive branch. The Respondents have persisted in this misinterpretation despite notice that their interpretation of the statute was a misinterpretation, and will no doubt proffer the same misinterpretation to this Court as their initial response to this petition.
Researchers, scholars, writers and news media—and Petitioner has attributes of all of the foregoing—have a “tangible interest” in many public citizens without any “relationship” to those persons. Petitioner is sensitive to privacy issues and identity theft issues. But no one is likely to try to hold themselves out to be “Barack Obama” using a birth certificate issued by Respondents.
Nevertheless, the very vehemence with which Hawai’i officials have misconstrued a state statue, and the manner in which Obama has attempted to manipulate and control access to his personal records (see infra), raise legitimate suspicions in the mind of the public.
b. The waiver and admission issues
Obama claims that he has posted a conformed copy of his birth certificate on a web site. It is impossible to say whether this assertion is true, because Petitioner has no official copy to compare to the Internet version. Obama has not posted any of the source information or supporting data. If Obama has posted a version of his birth certificate, it would appear he has waived any privacy issues and the statutory restrictions on issuance of a copy to Petitioner no longer apply.
It is indeed a very peculiar state as now exists where Obama claims he has released his birth certificate or at least his latest version of the document, and yet claims that no one should be able to obtain an official copy of the same document from the State of Hawai’i or review the source information for the certificate. Waiver would appear to be applicable and render nugatory any privacy concerns.
Obama has claimed he was born in a Honolulu hospital, but there is no verifiable evidence to sustain that claim. An examination of birth records is thus essential to resolve the lingering doubts.
As judges, certainly the members of this Court are aware that punctilious concern for accuracy would mandate that any counsel preparing a case in which the birth certificate was an issue, must obtain a certified copy and not a copy grabbed off an Internet web site. As an author and columnist, Petitioner adheres to the same high standards of accuracy in the search for original truth.
The fact that Obama has in fact posted his birth certificate on the Internet is a confirmation that he believes that issue is a topic of legitimate public interest.
D. The common law writ of mandamus
Petitioner has reviewed this Court’s jurisprudence concerning and construing the common law writ of mandamus. Petitioner submits that the extraordinary facts of this Petition provide a basis for extraordinary and emergency action. As the attached docket sheet from the Pennsylvania Supreme Court attests, Petitioner is experienced in preparing, filing and obtaining relief through extraordinary writs on an emergency basis.

CONCLUSION

Most respectfully, Petitioner asks this Court to take emergency action and to grant one of the alternative forms of relief outlined in this petition.

(HONOLULU, HI)(October 20, 2008) You have to turn to Hollywood and “High Noon” to find more drama than the confrontation building in Hawai’i. The good sheriff stands alone against the Obama Gang. Eliot Ness and the Untouchables? The Long Ranger? Pick your own hero. Martin vs. Obama explodes into a Hollywood classic.

I will do my best to defeat Obama even though I essentially stand alone. I stand tall. All of the protagonists are from Chicago. Despite ridicule and envy from Chicago’s corrupt mainstream media, I have spent over forty years successfully fighting crooked politicians like Barack Obama and his Daley Machine cronies.

But take a look at one of the most dramatic time lines in recent political history.

Two weeks ago on October 5th Sean Hannity aired a program that terrified the Obama campaign. You can probably see my role at FoxNews.com or on YouTube. The New York Times itself reported that the morning after Hannity’s program, I became the target of a massive liberal assault at the Times. On October 6th I wrote a column predicting that Hannity’s show would become the most important political program of 2008. On direct orders from the Emperor Obama, the New York Times then unleashed its smear machine on me.

One week ago, on October 13th, the Times tried to destroy me with a front-page package of lies, distortions and outright fraud. The Times failed. My investigative team arrived in Hawai’i and began to dig, dig, dig.

I also predicted in a column that attacking me was the first big mistake Obama and the Times had committed. You be the judge of whether I am being proven correct.

I am still standing and the Times’ credibility is going into the toilet.

Before my team left for Hawai’i I predicted we would bring down Obama. By sheer coincidence, one TV network was interested in my mission and has been tagging along with a camera crew.

Monday (today) we petitioned the Hawai’i Supreme Court to order Obama’s secret birth records released.

How did Obama respond? He suddenly discovered that his grandmother, who had supposedly been released from her hospital a week ago, when he showed no interest in her, needed his immediate attention. Cool, calm, collected Obama suddenly suspended his campaign and headed for Hawai’i.

High Noon.

I have been issuing reports from Hawaii and we are on the streets digging for the truth. This weekend we issued our story list for Monday-Wednesday (Monday has been rescheduled—see above).

What has Obama done? Cancelled his campaign and announced he is jumping on a plane to join Andy Martin in Hawai’i. Welcome home, Barry (Obama’s grandmother calls him “Barry.”)

Barack Obama vs. Andy Martin. The drama builds as we move closer and closer to disclosing the dramatic truth about Barack Obama.

Was I right when I predicted Obama made a classic mistake when he attacked me? Will Jim Rutenberg and all of the other Times slimeballs regret their malicious attacks? You betcha.

Obama did not pay any attention to his grandmother until I showed up in Honolulu. Suddenly she is the center of his attention. She is so central to his campaign that he has suspended it! But when Obama was here last summer he only visited his grandmother for an hour. One hour! Now he suspends his campaign for her?

Could anyone have predicted a more dramatic series of developing events? Hannity puts me on the air as the Chicago expert who confirms the links between Obama and his longstanding anti-American, terror network. Obama’s goon squads immediately try to smear me in retaliation. The New York Times creates a front-page story out of 25 and 35 year-old nonsense in a desperate attempt to discredit and derail my upcoming Hawai’i investigation.

And Andy Martin’s investigative team lands in Honolulu and goes where no mainstream media have gone before, on the streets of Honolulu to dig out the secret truths about Barack Obama.

Hawai’i Five-O looks tame by comparison.

I am still standing, fighting, and investigating, right here in Obamaland. And Hannity’s dramatic show on October 5th will prove to be the turning point in the fight to retake America from the Obamabots and their crooked clandestine campaign cash (Without Andy, Hannity’s second show on October 19th was dull by comparison and provoked no response from the Times or Obama).

The day we landed in Honolulu was Obama’s D-Day. He can’t scare us. He can’t stop us. He can’t intimidate us and the New York Times can’t smear us with lies, half-truths and distortions.

The irony in all of this television drama is that Fox News is not the network following me around Hawaii. I will leave it to the network to disclose which one it is.

Barack Obama is looking increasingly like a desperate, doomed candidate whose Big Lie is about to be exposed.

The New York Times tried to suggest I exaggerate. Do I exaggerate? Apparently Barack Obama doesn’t think so. He knows what I know. And soon you will know what Obama and I know.

What Obama fears most is that I search for the truth not because I am associated with McCain (I am not) or because I am a partisan Republican (I am not a right-winger). Rather I search for the truth for the sake of the truth, the whole truth and nothing but the truth. I took an oath as an 18 year old to defend the Constitution of the United States from its enemies.

Barack Obama is an enemy of the Constitution. He is using tens of millions of dollars in clandestine campaign cash from unknown sources to stage an electoral coup d’etat in our nation. That is why I keep fighting for the truth.

Over the next four days our conclusions will startle you, drive the New York Times crazy, and change the focus of the presidential campaign from “Who is Barack Obama” to “How did he get away with it for so long?”

At the end, my column on Wednesday the 22nd will be filled with sadness and pity, not anger. Obama’s real story is a sad story, a story that remains to be written and rewritten.

When we landed in Honolulu the local dispute was over whether Obama is “Hawaiian enough.” Hawai’i Governor Lingle had stated in Nevada that Obama’s ties to Hawaii were tenuous. That produced a backlash from Obama megaphones. I agree with Michelle. Hawai’i is where you find the truths about Obama, especially the truths that Obama does not want you to find.

Obama uses Hawai’i the same way he uses everything else in his life. Places, people, experiences, the past are there to serve Obama, not the truth. Maybe he and Mr. Kurtis should get together. For myself, I am interested solely in the facts and the truth.

The hidden truths about Obama will be presented in three parts:

Obama is in some respects a metaphor for Hawai’i itself: insular, isolated, and detached. Honolulu is a city of dazzling modernity. But Hawai’i is also a place where native Hawai'ians can grow to adulthood without a working knowledge of English. There are contradictions galore in Hawai’i, and Obama is the crown jewel of contradiction and conundrums. But there are consequences to contradictions.

The last time I told the truth about Obama, he unleashed his attack dogs at the New York Times to smear me. We will be filing suit in a few days to expose the New York Times as an Obama handout, not an independent newspaper (see below). And when this series is complete, you can expect the Times and mainstream media (“MSM”) to renew their attacks on me.

My background is clear: since I first went to Viet-Nam forty-one years ago, I have been breaking news and irritating powerful people, ending up on presidential enemies’ lists and the like. But no one has ever successfully attacked my facts. Truth is my passion; accuracy is my overriding goal. I have an unblemished 40-year record spanning the rice paddies of Asia to the deserts of Arabia.

Obama will not like what I have to say in this series. But, no surprise, Republicans may not like what I write either.

This series will be a postpartisan look at Obama. I have no ties to any campaign, and no ties to either party (I vote in Republican primaries). I have deep affection for the frustrated voters in both parties who desperately want the truth. In analyzing candidates we apply different filters and different templates, and often reach different conclusions than the MSM. We are the later day embodiment of Hawai’i Five-0, an old TV series that still holds a place in the hearts of Hawai’ians. We get it right in the end: “Book’em Danno.”

We are the first investigative team to come to Hawai’i. How strange that MSM’s have ignored a place that Michelle Obama calls so critical to understanding her husband. Because of my obsession for factual accuracy and relentless search for the truth about Barack Obama we landed the first team in Honoolulu. We have now begun a litigation operation as well as an investigaiton, all targeted on ferreting out the truth about Obama’s past.

In my book “Obama: The Man Behind the Mask,” I try to get behind Obama’s “mask.” The first chapter of the book is a psychological profile of the man. It has served well as an insight into his character and psyche.

Here are some general observations to open the series.

First, MSM often overlook that the Dunham Family, Obama’s mother and grandmother, were strangers in this state. The Dunhams went from Kansas to Washington State. Their daughter grew up and graduated from high school in Washington. (Stanley) Ann Dunham arrived in Honolulu as a disoriented young adult, an outsider in an insular culture. That is why Ann gravitated to the University of Hawai’i, which serves as an oasis of cosmopolitanism for the island state. Nothing in Washington prepared her for Hawai’i.

Out of this confusion and upheaval came Barack Obama, a man of three families: his mother’s family, his grandparents’ family and his secret family.

When I began writing about Barack Obama over four years ago, the only “source” was his brilliant novel about himself, “Dreams From My Father.” The book is a fantasy, not an autobiography, with invented characters and dialogue, and missing periods of his life. Obama is indeed a fascinating story, and we will tell it for the first time. A story of young love, and loss. A story of ultimate discovery and a voyage into an endless unknown of the soul. Will we get it right? I pray that we do, although I missed church at St Andrew’s Cathedral this morning. I will let history be the judge of this series.

And I will close with a stark reminder.

Four years ago I exposed on WMUR-TV (Manchester, NH) who George Bush really was. No one wanted to listen. Bush’s henchmen tried to destroy me (and obviously failed).

Today Americans are caught in an increasing hysteria, a crescendo of projection and fantasy. But the inescapable lesson of history is that there is always a real world looming behind the fantasy. A mask is still a mask; indeed, a mask is always a mask. I have called Obama a masked man in my book, and others call me a masked man (the “Lone Ranger”) for my relentless pursuit of the truth about Obama.

In the end, the real world always wins. Truth triumphs. And fantasy usually leads to bitter disappointment and dismay. If you don’t believe me, just ask George W. Bush.

I leave the good reader to judge my truths about Barack Obama, and act accordingly.

COMPLAINT FOR DECLARATORY JUDGMENT

Plaintiff ANDY MARTIN (“Plaintiff”), pro se, alleges in his Complaint for Declaratory Judgment against the Defendants as follows:

PARTIES, JURISDICTION AND VENUE

Plaintiff ANDY MARTIN is the author of a book on Senator Barack Obama (“Senator Obama”). He has also been writing columns and commentary about the senator for over four (4) years.
Defendants LINDA LINGLE and DR. CHIYOME FUKINO are Governor and Director of the Department of Health, respectively.
This Complaint for Declaratory Relief and these proceedings are instituted pursuant to § 632-1, Hawai’i Revised Statutes.
Venue is proper in this Court pursuant to § 603-36, Hawaii Revised Statutes.

STATEMENT OF CLAIM

1. Plaintiff requested a certified copy of the birth certificate of Senator Obama from the Department of Health and tendered the requisite fee.
2. Defendants refused to provide a copy of said certificate, invoking the confidentiality statutes of the State.
3. The issue of the Senator’s birth certificate has become a controversial topic of intense national speculation.
4. As an author who strives for factual accuracy and attempts to conduct thorough research Plaintiff wants a copy of the Senator’s birth certificate attested to by the State and not a “certificate” which is posted on a web site and which has been debunked as possibly having been altered.
5. One of the more literate and temperate analyses of the unlawfulness of the Defendants’ refusal to issue certified copies of the birth certificate is contained in Exhibit 1 attached hereto.
6. To the extent that the Defendants’ files contain or retain original supporting data for the birth certificate, Plaintiff asks that he also be supplied with that information and/or material as well.
7. It is axiomatic that the birth certificate of a presidential candidate is a document of crucial public concern and significance.
8. While Hawai’i statutes call for a balancing or weighing test where production is considered by a court, most respectfully Plaintiff submits that the balance falls entirely on the side of disclosure where the original birth certificate of a presidential candidate is concerned.

DECLARATORY RELIEF SOUGHT

9. Based on the relevant statutes and constitutional law, including Article One, Section 4 (“freedom of the press”) and § 92F-15 (e) and § 338-18 (a) (9), Plaintiff asks that the Court direct and order defendants to turn over forthwith a copy of Senator Obama’s birth certificate and related files and records, and without any delay.
WHEREFORE, Plaintiff Andy Martin prays for relief as follows:
A. For a declaration by this Court that Plaintiff is an author and writer and is a person to whom the birth certificate of Senator Obama can and should properly be delivered forthwith;
B. For such other relief as this Court deems just and equitable.

1. This lawsuit does not involve complicated or disputed facts.

“I want to see a certified copy issued by the State of Hawaii, not one issued by the State of Obama. Why Obama won't allow direct access to his birth records is beyond me. But the closer we get to discovering the truth about Obama the more we understand why he is terrified of that truth.

“What is Obama hiding? Frankly, after being in Hawaii and conducting our first round of interviews, we think we have a clearer picture of what Obama is concealing, and why. We have more research and interviews to conduct before we can announce our opinions.

“In the meantime, I filed a lawsuit against the State of Hawaii to require the state to open Obama’s birth records. The Governor and Director of the Department of Health are named as defendants.

“The case has been docketed as number 08-1-2147-10 and assigned to Circuit Judge Bert Ayabe.

“We will distribute copies of the lawsuit at a Saturday morning news conference, as well as making them available on a limited basis Friday evening upon written request. We will hold the Saturday morning news conference in front of the courthouse to provide additional information.

“Friday evening I will be available by cell phone from Ala Moana Beach Park.

“We will issue a news release later Friday with details of Saturday’s news conference.

“The basic question remains: why is Obama trying to hide his life from birth to adulthood from the American people? Interestingly, we think we also know now why he has virtually imprisoned his white grandmother and refuses to allow her to appear in public. Who is the man behind Obama’s mask? I think my book ‘Obama: The Man Behind The Mask’ is aptly titled.

“Next week, we believe we will be in a position to remove Obama’s mask and confront him with the truth about who he is and what he is.

“One TV news network has already tentatively scheduled a conference in New York on our return.”

THIRD CITY JEALOUSY, PETTINESS AND PROVINCIALISM OOZE OUT OF CHICAGO

“OPERATION ALOHA OBAMA” HAS BEGUN

(HONOLULU, HI)(October 16, 2008) First the good news. Our new fighting camp in Honolulu is fully operational. We have set up our communications, computers, printers and everything else within 24 hours of arrival. We are already out in the field doing our Obama research.

One national television network has already requested to cover this mission and we expect to liaison with them shortly.

Mainland media are also responding; we will be up late into the night appearing on radio on the mainland Friday morning (during the morning hours).

All in all, it’s not a bad record for a small Internet operation that has been breaking news from Baghdad to Chicago over the past five years.

And oh the jealousy, pettiness and provincialism oozing out from all over the Chicago area. Richard Roeper of the Chicago Sun-Times kicked off the parade by trying to trash me with some lies emanating from the New York Times Obama Bureau. Roeper could not be bothered to pick up the phone and check out the facts, or at least get both sides of the story. Major market attitude, that, Mr. Roeper.

Then, horrors!, two losers from the (Somewhere) Daily Herald wrote that I was not a “journalist.” As though I need to be lectured by a third-rate daily in the burbs, they’re right. If by “journalist” you mean someone who is cowering in fear of losing his ‘dead tree’ media job, while waiting to answer a police call on a turned-over truck, no, I am not a journalist. But I have been breaking major investigative stories since the 1960’s, and irritating people in power from presidents on down. Not bad work if you can get it.

Finally, the odious and officious Mark Brown of the Chicago Sun-Times tried to write himself into my story and compared me to racists and terrorists. Brown opined that he had known me for over thirty years. He may have known me, but I have no idea who he is or was.

Each of the foregoing munchkins is trying to outdo the grand master of Chicago resentment and obsession, Rick Pearson of the Chicago Tribune, who burns with anger at the very sound of my name. Pearson has yellowed notes with a collection of smears against me he reprints every two years. Pearson’s problem is that he drinks his own toxic Kool-Aid. Sam Zell, the new owner of the Tribune, will soon dispatch him.

Well, what have I done to deserve this obloquy? I won’t mention my clandestine accomplishments in Chicago because, well, they are clandestine and must remain so. But how about the public accomplishments?

As a young law student, I worked with real reporters to help bring down two crooked Illinois Supreme Court judges. Not bad for a student lawyer.

Throughout the 1970’s I was fighting corruption in Chicago. I filed the first racketeering lawsuits against the Democratic Party and earned the ultimate award of undying enmity from the Daley Machine(s). I helped target crooked judges, culminating in Operation Greylord. Fight corruption in Chicago? Horrors. Now you know why they hate me. (Check out http://www.andymartin.com/)

I performed the same miracles in Florida, where trial and appellate judges were disciplined and removed as a result of my activity.

From time to time I took time to report from overseas. In 2003 I worked in Baghdad as an investigator and researcher. Just ask Paul Bremer what he thinks of me. I saw through Mr. Bremer earlier than anyone else. And gained the enmity of the Bush administration.

Today I am the only American writer/investigator/”journalist” looking into Barrack Obama’s hidden history in Hawaii.

As I look out my window at the blue ocean, white waves and white sandy beach where I will be walking with my new pair of sandals (going native already), I can only express sympathy and amusement at the vitriol directed at me from my home town competitors. We can see why the Second City is now the Third City: jealousy, pettiness and provincialism.

Seems to me the greatest self-promoter of all time, Jesus Christ, had a few choice words for Roeper, Ryan, Pearson and Brown. “A prophet is not without honor…”

We’ll have an introductory column later today, and then the red meat starts on Friday. Get your steak knives, forks and napkins ready and prepare to feast on what we discovering about the “unknown Obama” in Hawai’i.

(NEW YORK)(October 14, 2008) The leader of the national anti-Obama movement, legendary Chicago Internet columnist and Obama author Andy Martin, will hold a New York news conference Tuesday, October 14 to announce that his mission will land in Honolulu on Wednesday, October 15th to begin the first investigation of Barack Obama's "lost Hawaii."

The Obama investigation has already received threats.

"We are notifying appropriate law enforcement," Martin will state. "We have no way of gauging the seriousness of these threats. But people were already concerned for our safety. Receiving threats does not make it any easier. Some of us have a feeling we are heading into a hornet's nest of secret evidence involving Obama's concealed past; that is the reason why he has been smearing me using his media puppies during the past week. In any event, we take threats very seriously.

"Obama's campaign is led from behind the scenes by people who have a history of extremely violent action. His authoritarian personality also lends itself to violent support. We will exercise all appropriate security precautions.

"And we will not be intimidated from seeking the truth in Hawaii about the mysterious Mr. Obama."
